Terms of Use

1.                Definitions

(1)               “CUCSM” means the Country Universities Centre Snowy Monaro (or CUC Snowy Monaro), operated by Cooma UC Incorporated for the purpose of providing CUCSM Resources to allow users to complete studies at a university or other tertiary level education provider.

(2)               “CUCSM Resources” means:

(a)               the CUCSM building, 38 Bombala Street, Cooma, which contains kitchenette, bathrooms, social spaces, study areas, AV rooms and meeting rooms; and                                            

(b)               CUCSM.net, which means the computer network and equipment including hardware, software and network connectivity.

(3)               “Network Use Policy” means the policy which CUCSM Users and CUCSM staff must adhere to when using the CUCSM.net.

(4)               “Opening Hours” means normal office hours of 8.30am–5.00pm Monday to Friday or as specified by the CUCSM.

 

2.                Registration

(1)               To register for access to and use of CUCSM Resources you must:

(a)               be enrolled in a course of study at a university or other approved tertiary education provider;

(b)               complete the Registration Form and submit it to CUCSM staff; and

(c)               provide a hard copy of your current enrolment.

(2)               Once processed, your registration will be for an initial term of six months.  You may renew your registration for further terms of six months, provided that you continue to be enrolled in a course of study at a university.

(3)               If you decide that the CUC Snowy Monaro is not for you, you may withdraw your registration within 10 days of completing the Registration Form.

(4)               During the term of your registration, the CUC Snowy Monaro (Cooma UC Incorporated) will provide you with access to and use of the CUCSM Resources, subject to these Terms of Use.

 

3.                Your obligations

(1)               While using the CUCSM Resources, you must comply with:

(a)               these Terms of Use;

(b)               the Network Use Policy; and

(c)               the Swipe Card Use Policy.

(2)               While using the CUCSM Resources you must:

(a)               take reasonable care for your own health and safety;

(b)               take reasonable care to ensure that you do not adversely affect the health and safety of others; and

(c)               comply, so far as you are reasonably able, with any reasonable instruction of CUCSM and Cooma UC Incorporated; and

(d)               report any safety hazards you may become aware of to CUCSM staff.

(3)               You must observe the following standards of behaviour while using CUCSM Resources or in dealing with CUCSM staff and other CUCSM users:

(a)               comply with all lawful and reasonable directions policies and procedures of CUCSM and Cooma UC Incorporated;

(b)               refrain from any conduct that may cause any reasonable person unwanted offence, annoyance or embarrassment; and

(c)               respect Cooma UC Incorporated’s ownership of the CUCSM Resources by protecting them and using them responsibly.

(4)               Under no circumstances is the following permitted at the CUCSM:

(a)               smoking, drugs or alcohol;

(b)               anti-social behaviour;

(c)               unregistered users; or

(d)               children.  Regrettably the CUCSM is not set up to accommodate children and in the interests of other users children are not permitted at the centre.

(5)               At the end of your 6 month term and if you do not extend your existing registration you must return any CUCSM property to Cooma UC Incorporated.

 

4.                Disclaimer

(1)               Continuity and connection speed of internet access depends on a wide range of factors, many of which are beyond the control of CUCSM.  Consequently, CUCSM accepts no liability for any disruptions to internet access.

(2)               CUCSM accepts no responsibility for any damage to or loss of data, hardware or software arising directly or indirectly from use of CUCSM Resources or for any consequential loss or damage. CUCSM makes no warranty, express or implied regarding CUCSM Resources, or their fitness for any particular purpose.

(3)               While CUCSM seeks to ensure your privacy it cannot guarantee the confidentiality of any information stored on or transmitted through CUCSM.net.

 

5.                Termination

(1)               If Cooma UC Incorporated or CUCSM considers that you are in breach of these Terms of Use, the Network Use Policy or the Swipe Card Use Policy, they may give you a written warning or terminate your registration immediately.

(2)               If you do not respond to the written warning within 14 days, CUCSM may terminate this agreement by giving you written notice.

(3)               CUCSM will consider your response to the written warning and will either:

(a)               withdraw the written warning;

(b)               allow you to continue to use the CUCSM Resources subject to conditions; or

(c)               terminate this agreement by giving you notice in writing.

(4)               If CUCSM has issued you a written warning in the past and considers that you have committed a further breach of these policies, CUCSM may terminate this agreement by giving you notice in writing.


Network Use Policy

1.                Definitions

Swipe Card Use Policy

1.                Purpose

This policy describes the acceptable use of the Swipe Card System provided by Cooma UC Incorporated at the CUCSM.  Usage of the swipe card system is at all times subject to this policy. 

2.                Scope

This policy applies to all CUCSM staff and users of the centre.

3.                Principles

Once CUCSM staff have processed the student’s registration form they will be issued with a swipe card. Students may use the swipe card system to access the centre outside staffed hours (but within set timeframes).

4.                Authorised use

(1)               CUC Snowy Monaro (Cooma UC Incorporated) provides access to centre for use associated with your studies.

(2)               At the end of your registration term and if you do not extend your existing registration you must return any swipe cards or any other CUC Snowy Monaro property to the centre.

5.                SWIPE CARD

CUC Snowy Monaro (Cooma UC Incorporated) will issue you with a swipe card to access the CUCSM building. You must not allow anyone else to use the swipe card or use a swipe card that does not belong to you.

If your swipe card is lost or stolen you must report it to CUCSM staff as soon as possible. A replacement cost WILL be involved at Cooma UC Incorprated’s discretion.

6.                ENtry HOURS

(1)               The CUCSM will be staffed and the door open during normal business operating hours: 8.30am - 5.00pm

(2)               The CUCSM will be accessible to registered students with valid swipe cards from 7.00am - 11.59pm Monday to Sunday

(3)               The CUCSM will be alarmed with back-to-base security at 11.59pm every night. If any students remain inside the centre once the alarms are set, they will be responsible for any associated emergency services call out costs and may have their CUCSM registration terminated.

(4)               The CUCSM will be alarmed until 7.00am every morning. Access by swipe card will not be allowed or possible until 7.00am.

(5)               Access to the Cooma Universities Centre is constantly watched by CCTV and the Cardax monitoring system. Do not let other people use your swipe card. If something happens in the centre while our systems identify you as using the centre, responsibility will fall to you.

(6)               The centre will be closed completely with no swipe card access over the Christmas / New Year’s period.                                                                            

7.                Prohibited ENTRY

8.                Monitoring

CUCSM collects statistical data regarding the CUCSM users movements.CUCSM monitors the use of the swipe card systems to ensure the ongoing availability, reliability and security of these systems, including to detect unauthorised usage and other problems.


Privacy Collection Statement

Country Universities Centre Snowy Monaro and Cooma UC Incorporated (“we”, “us” or “our”) is committed to respecting your privacy and complying with all of our privacy  obligations under the Privacy Act 1988 (Cth) (Privacy Act), including the Australian Privacy Principles.

CUC Snowy Monaro[DT1] (“we”, “us” or “our”) is committed to respecting your privacy and complying with all of our privacy  obligations under the Privacy Act 1988 (Privacy Act), including the Australian Privacy Principles.

We are collecting your personal information submitted as part of your Registration Form. This includes:  your name, gender, address, telephone number, other contact details (including emergency contacts and email addresses), transaction details, and medical history, in order to assess your eligibility to use the CUC Snowy Monaro[DT2] . CUC Snowy Monaro may also collect sensitive information about an individual with your consent or in order to comply with our obligations under Australian law, including but not limited to:

·                     language or cultural background;

·                     citizenship status;

·                     status as an Indigenous Australian;

·                     disability status; and

·                     health information

This assists us to correspond with you, to facilitate you receiving appropriate assistance in the event of an emergency, for quality assurance and planning purposes, to align strategy and resourcing with need, to promote the CUC Snowy Monaro in the media and with stakeholders, and to comply with legislative reporting requirements. We will only collect your sensitive information with your consent or if required by law. If we do not collect this personal information, we may not be able to provide you with our services, either to the same standard or at all. 

When you submit your Registration Form we will ask you whether you want us to let you know by any means (including SMS or e-mail) in the future about goods, services or promotions which may be of interest to you.  You can decline this service at that time or opt out in the future by contacting our Privacy Officer on the details below.

Any personal information collected, stored, used and disclosed by us will be treated in accordance with the Privacy Act and our Privacy Policy (available at: www.cucsnowymonaro.org.au or requesting a copy from CUC Snowy Monaro staff).
